General Terms and Conditions (GTC)

for shop and ticketing offers from Moving Adventures Medien GmbH
(as of July 2025)

1. Scope

1.1 These General Terms and Conditions (GTC) apply to offers made by Moving Adventures Medien GmbH (hereinafter: “MAM” or “we”) to consumers (hereinafter: “customer“ or “you”) in the online shop outdoor-ticket.net (purchase of products and event tickets). Separate terms and conditions may apply to deliveries to commercial customers (e.g., resellers) and to agency services provided by MAM; these cannot be ordered via the online shop.

1.2 “Consumer” is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).

2. Contractual partner

2.1 The contractual partner for the purchase of products and tickets for MAM's own events is:

2.2 Tickets for events organized by other organizers: If an event description mentions an organizer other than MAM, the contract for attending the event is concluded between the ticket purchaser and the named organizer. The organizer's general terms and conditions may apply to this contract, and MAM is not a party to this contract. The organizer is therefore solely responsible for any queries, cancellations, or changes; the customer has no claims against MAM in this regard.

3. Conclusion of contract

3.1 General: The presentation of products or events in the web shop does not constitute a legally binding offer, but rather an invitation to place an order.

3.2 Order process

3.2.1 Shopping cart system: On the product detail page for a specific product or for tickets for a specific event, you can place the desired quantity in the virtual shopping cart. You can view the contents of the shopping cart at any time by clicking on the shopping cart icon (top right). Click on the “Add to cart” button to start the ordering process.

3.2.2 Order contents: You can adjust the contents of the shopping cart by deleting individual items or changing the quantity.
Voucher: If you want to redeem a voucher, please enter the voucher code here.
Billing address and contact details: You will be asked to enter your first and last name, address, and email address.
Payment method: Please select from the available payment methods. If you select payment by credit card/Apple Pay/Google Pay, you will be asked to enter your card details here. If you select payment by “Sofortüberweisung” (Klarna) or PayPal, you will be redirected to the respective payment provider immediately after completing your order. Click the “Continue to order overview” button to continue the ordering process.

3.2.3 Review: You will receive an overview of your entries and the selected payment method. If you want to correct your entries, use the pencil icon next to the respective area. You can also cancel the order process and close the page or tab in your browser. Only when you click on the “Place order” button will your order be submitted. This completes the order process. If you pay by instant transfer (Klarna) or PayPal, you must make the payment immediately afterwards.

3.2.4 Acceptance of the order: The submitted order is your binding offer to conclude a contract. You will immediately receive an email confirmation of receipt of your order. This merely confirms receipt unless we also expressly accept the order in it. A contract is only concluded when the order is accepted. You will receive confirmation of acceptance or rejection of the order by email within three working days.

3.3 Payment: If you are paying by “Sofortüberweisung” (Klarna) or PayPal, you will now be redirected to the respective payment provider.

3.3.1 Order confirmation: You can save or print the terms and conditions before submitting your order. However, you will also receive a confirmation email from us containing the order details, the terms and conditions, and the invoice.

3.4 Availability: MAM does not guarantee the availability of all products at all times. In the event of unavailability, we will notify you within the acceptance period (Section 3.2.4). If the contract has already been concluded, we are entitled to withdraw from the contract within 3 business days in the event of unavailability of an ordered product.

4. Shipping costs

Shipping costs may apply for the delivery of physical products and tickets. The amount of shipping costs may vary depending on the shipping method, type of item (e.g., ticket or physical product), destination country, and provider. The shipping costs to be paid will be displayed during the ordering process before you place your order. If it is not possible for us to calculate the specific shipping costs for deliveries outside Europe with reasonable effort, we will inform you before you place your order that separate shipping costs will be charged. For deliveries outside the EU, you may have to pay import duties or similar charges.

5. Delivery

5.1 E-tickets are not delivered in physical form (see section 10).

5.2 Shipping tickets (tickets in physical form) are delivered uninsured by post within 5–10 business days. Delivery is only possible to addresses in Germany.

5.3 Products are delivered by DHL within 5–10 business days. We may make partial deliveries if this is reasonable for you. In any case, we will bear the additional shipping costs incurred as a result. DHL will notify you by email of any changes to an announced delivery time.

5.4 We bear the risk of loss or damage during shipping until you or a person authorized by you takes delivery.

6. Payment

6.1 The following payment methods are available:

  • Credit card (MasterCard, Visa)
  • Apple Pay & Google Pay
  • “Sofortüberweisung” (Klarna)
  • PayPal

6.2 If you have selected payment by “Sofortüberweisung” or PayPal, you must make the payment via the respective payment provider after completing your order. You will be redirected from our online shop to the payment provider (see section 3.3). These payment providers are:

  • Klarna Bank AB (publ), P.O. Box 900162, 90492 Nuremberg
  • PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg
If you have selected credit card payment or payment with Apple Pay or Google Pay, the payment will be made via your credit card company (Visa or Mastercard) or via Apple or Google using the payment method stored with Apple Pay/Google Pay.

6.3 The payment process is subject to the general terms and conditions of the respective payment provider. We do not store any payment-specific data. Payment processing is carried out by certified service providers (e.g. Stripe or PayPal).

6.4 The payment method will be charged upon completion of the order, or immediately upon initiation of the payment via the payment provider in the case of instant bank transfer or PayPal.

6.5 Non-payment: If we do not receive payment from you, e.g. because you have canceled the payment process or a payment has been canceled/reversed, we will reject the order. If the contract has already been concluded, we are entitled to withdraw from the contract within 3 working days.

7. Invoicing

An invoice with VAT will be provided for each order via a download link in the confirmation email.

8. Retention of title

The delivered goods or a physical ticket remain the property of MAM until full payment has been received (§ 449 BGB).

9. Vouchers and discount codes

9.1 Vouchers that we issue free of charge as a promotional measure are voluntary benefits. As described when the voucher is issued, a voucher is valid for a limited period, is non-transferable, and cannot be redeemed for cash.

9.2 Value vouchers that we sell at a price corresponding to the value of the voucher are valid for three years, beginning on December 31 of the year in which we sold the voucher.

9.3 Vouchers (both free vouchers and value vouchers) may be limited to certain products, categories, or promotions and can only be redeemed in the online shop. Vouchers cannot be combined with other discounts or promotions.

9.4 To redeem a voucher, you must enter the voucher code when placing your order. The value of the voucher will be deducted from the total price of all items in the shopping cart and any additional costs, and you will only pay the reduced amount.

9.5 If the value of a free voucher (Section 9.1) exceeds the total price of the items in the shopping cart and any additional costs, the remaining value of the voucher will expire; which cannot be transferred to another order.
In the case of a value voucher (Section 9.2), the credit balance is reduced by the amount deducted from the total amount in accordance with Section 9.4.

The remaining value can be used for another order (or several orders) within the validity period (Section 9.2).

Alternatively, you can request payment of the remaining value within the validity period; if you provide your bank details, we will use the payment method you last used for an order. Once we have paid out the current credit balance, the voucher will become invalid

10. Additional conditions for tickets

10.1 Electronic tickets (e-tickets) are digitally valid and have a one-time QR code. Within 30 minutes of placing your order, you will receive a PDF file by email that you can save on your smartphone or print out. You are responsible for ordering e-tickets in good time before the event and for having either Internet access, an Internet-enabled device with a PDF viewer, a printer, and paper to print out the PDF file, or a smartphone on which you can display the saved ticket at the entrance.

10.2 It is your responsibility to order tickets for delivery in good time before the event, taking into account the specified delivery period (Section 5.2).

10.3 Tickets delivered in physical form must be kept safe. You are not entitled to a replacement in the event of loss, theft, or misuse. This applies accordingly to the email received with an e-ticket and the QR code displayed therein.

11. Right of withdrawal

11.1 No right of withdrawal for tickets
According to Section 312g (2) No. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts for “services in connection with leisure activities if the contract provides for a specific date or period for the provision of the service”; this applies to all tickets for events offered in the online shop.

11.2 For contracts for the purchase of products in the online shop, you have a 14-day right of withdrawal.
The following applies to a contract for goods or merchandise delivered as part of a single delivery:

The withdrawal period will expire after 14 days from the day  on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Moving Adventures Medien GmbH, Thalkirchner Str. 58, 80337 München, Tel.: 089 / 38 39 67–80, E-Mail: info@moving-adventures.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You are only liable for any diminished value of the good resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

12. Warranty and liability

12.1 Shop products: The statutory warranty rights apply. We are not liable for damage caused by normal wear and tear, improper use, or external influences (e.g., water, fire) that are not due to a defect in the product.

12.2 Tickets/events: Tickets remain valid in the event of postponement. Alternatively, the ticket price will be refunded (excluding any additional fees charged by the seller). Open-air events take place in all weather conditions. You are not entitled to a refund in the event of bad weather. If, in exceptional cases, an event has to be canceled for safety reasons due to severe weather, you are entitled to a reasonable refund.

If an event is canceled before the intermission, you will receive a full refund of the ticket price, otherwise half the ticket price.

Please note that for events organized by another organizer, that organizer is your contractual partner and their terms and conditions apply (see section 2.2).

12.3 Liability for intent or gross negligence: Our liability for intent or gross negligence, for culpable injury to life, limb, or health (personal injury), for the absence of warranted characteristics, from a guarantee, or under the Product Liability Act is always unlimited.

12.4 Liability for slight negligence: With the exception of personal injury, we shall only be liable for slight negligence in the event of a breach of cardinal obligations (obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely), and liability shall be limited to damages typical for the contract and foreseeable at the time of conclusion of the contract.

12.5 Limitation of liability in favor of third parties: The above limitation of liability also applies in favor of the organs, employees, and agents of MAM.

13. Data protection

Our privacy policy provides information about the type, scope, and purpose of the collection and use of personal data.

14. Out-of-court dispute resolution

The EU Commission provides a platform for online dispute resolution, but only until July 20, 2025: http://ec.europa.eu/consumers/odr/.

Note pursuant to Section 36 (1) VSBG: MAM is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Final provisions

15.1 Should any provision of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.

15.2 Any contract concluded via our online shop is subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this does not mean that you lose the protection of the statutory provisions of the country of your habitual residence, from which no deviation is permitted by contract.

15.3 The exclusive place of jurisdiction is Munich if you do not have a general place of jurisdiction in Germany or if you have moved your place of residence or habitual abode abroad after conclusion of the contract or if your place of residence or habitual abode is unknown at the time the action is brought. However, we are also entitled to bring an action before another competent court.
