TICKETING TERMS AND CONDITIONS


1. Scope
These general terms and conditions apply to all services / deliveries from Moving Adventures Medien GmbH (subsequently: MAM) to consumers*. They apply to the entire online offering on www.outdoor-ticket.net

*A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to his or her commercial or freelance professional activity.

2. Contracting partner
The purchase contract is concluded with Moving Adventures Medien GmbH, managing directors: Joachim Hellinger, Thomas Witt, Stefan Mauerer, Thalkirchner Str. 58, 80337 Munich, Munich trade register, Registration no.: HR B 135195. German law shall apply exclusively.

3. Conclusion of contract
3.1 The representations of the products on the ticket page do not constitute a legally binding offer but rather an invitation to place an order.
3.2 By clicking the [Confirm & pay] button, you agree to a binding order of the tickets listed on the ticket page. The contract of purchase is concluded upon receipt of our confirmation email immediately after we receive your order or through a corresponding confirmation letter.

4. Shipping costs
Mail-order tickets are only delivered within Germany. The shipping costs amount to €3.90 per ticket and are included in the ticket price. For further information on mail-order tickets please see item 9.2.

5. Delivery
5.1 The delivery of mail-order tickets is made by Deutsche Post to the address provided. A delivery to a DHL Packstation is not possible. The shipping will be at the risk of the customer. Moving Adventures Medien GmbH is not liable for loss or delay in delivery.
5.2 Delivery takes place within 5 to 10 working days. If delivery times change due to availability, you will receive an information email after receipt of your order.
5.3 If you notice that the goods you ordered are incomplete, that you have ordered something else or that the information on the tickets is incorrect, please contact our service team immediately (phone: +49 (0) 89/38 39 67-80 , fax: +49 (0) 89/38 39 67-40 or email: info@outdoor-ticket.net). Our customer service will be available for calls from Monday to Friday between 10am and 3pm.

6. Payment
6.1 The prices listed on the product pages include the statutory value-added tax. In the case of mail-order tickets, shipping costs are already included in the price. We do not assume any liability for printing or transmission errors in the display of prices. 
6.2 Payments can be made via credit card, PayPal or Klarna (instant bank transfer).
6.2.1 Credit cards
We accept MASTERCARD and VISA. Your credit card account is debited upon conclusion of the order. We cooperate with Stripe (https://stripe.com/) for the online handling of payments. Our payment software is SSL-secured and supports security programmes such as MasterCard Secure Code and Verified by Visa. We would like to point out that we do not store payment-specific data!
6.2.2 PayPal
The online payment system PayPal is available in more than 100 countries worldwide. The buyer pays for the goods with his or her personal PayPal account. This account has to be opened on www.paypal.de beforehand. You will also find all further information on payments with PayPal there. MAM will ship the goods after receipt of information on the processed transaction from PayPal.
6.2.3 Klarna (formerly known as Sofortüberweisung; Germany, Austria, Switzerland, Belgium, Netherlands and United Kingdom only)
Klarna is a TÜV-certified online payment system based on the established online banking process with PIN / TAN entry for the secure and quick processing of your online purchases. Klarna was developed by Payment Network AG and is already used for numerous online shops in Germany. Klarna automatically files a transfer in real time for your online bank account via Payment Network AG’s protected payment form, which is not accessible to the seller. The amount due is then transferred immediately and directly to the bank account of the seller. The system accepts the same PIN and recognises your bank’s valid TANs, because you log in to your bank account with these data. For further information please visit https://www.klarna.com/.

7. Title retention
The tickets remain the property of MAM until full payment is received.

8. Vouchers
MAM will issue vouchers for various occasions. This is a voluntary service of MAM. The vouchers expire after a certain period of time. The validity is noted on the voucher. Vouchers can be limited to certain brands, categories or campaigns. They can only be redeemed in MAM’s online shop. No cash reimbursement is possible for vouchers.

9. Conditions of use for online ticketing
9.1 Online tickets (print-at-home tickets)
The customer receives the ordered online tickets (print-at-home tickets) as a PDF by e-mail. These tickets can be presented digitally on a smartphone or as a printout for admission to the event. Each ticket has a unique QR-code. Before entering the event, this code is checked with a QR-code scanner. The multiple visit of an event by duplicated tickets is not possible.
The customer is obliged to keep the ticket protected to prevent duplication by third parties. In case of loss and/or misuse of the ticket, the customer has no right to visit the event or to a refund of the ticket fee.
9.2 Mail-order tickets
Apart from the statutory value-added tax and other price components, the prices for mail-order tickets also include shipping costs. 
Tickets are only delivered within Germany. Delivery takes place within 5 to 10 working days.

10. Right of withdrawal
Ticket orders and tickets are not subject to the Distance Selling Act according to Sect. 312b Clause 2 No. 9 of the German Civil Code. Therefore not right of withdrawal exists.

12. Information on dispute settlement
Complaints procedure via online dispute resolution for consumers (OS): https://ec.europa.eu/consumers/odr/. We are not willing and not obliged to participate in a dispute settlement procedure before a consumer arbitration board.

13. Final clause
Should one or several provisions of these general terms and conditions be ineffective, the effectiveness of the entire contract shall remain unaffected. The ineffective provision shall be replaced by the relevant legal regulation.
